1. Agreement to these terms
These Terms of Use ("Terms") are a contract between you and Prisma Labs ("Tonic", "we", "us") that governs your use of the Tonic mobile app and the asktonic.com website (together, the "Service"). By creating an account, tapping a button that says you agree, or otherwise using the Service, you accept these Terms and our Privacy Policy. If you do not agree, please don't use the Service.

Tonic is made by Prisma Labs, a sole proprietorship (eenmanszaak) registered in the Netherlands.

3. Tonic is not medical advice
This is the most important part, so we'll be blunt:
- Tonic is a wellness and self-tracking tool, not a medical device, and not a healthcare provider. It does not diagnose, treat, cure, or prevent any disease or condition.
- Nothing in the Service is medical advice. Content, estimates, reminders, and AI-generated coaching are for general information and motivation only. They are not a substitute for advice from your doctor, pharmacist, or other qualified clinician.
- Always talk to your clinician about your medication, dose, schedule, side effects, diet, and any health decision. Never start, stop, or change a GLP-1 medication or dose based on Tonic.
- In an emergency, call your local emergency number. Tonic is not for urgent or emergency care.
- Calorie, macro, and nutrition figures — including those produced by meal-photo analysis — are estimates and can be wrong. Don't rely on them for medical or clinical purposes.
You are responsible for how you use the information in the Service, and you use it at your own discretion and risk.
4. Eligibility
You must be at least 16 years old to use Tonic. If you are under the age of majority where you live, you may only use the Service with the involvement and consent of a parent or legal guardian. By using Tonic you confirm you meet these requirements.
5. Your account
You sign in with Apple; we never see your Apple ID password. You are responsible for keeping access to your device and Apple ID secure, and for activity that happens under your account. Tell us at [email protected] if you believe your account has been compromised. You can delete your account at any time in Settings → Account → Delete account.
6. Subscriptions, billing, and refunds
- Some features require a paid subscription. Subscriptions are sold and billed by Apple through your App Store account, under Apple's terms — not directly by us.
- Paid subscriptions renew automatically at the price and interval shown at purchase, unless you turn off auto-renew at least 24 hours before the period ends. Manage or cancel anytime in iOS Settings → your name → Subscriptions.
- Any free trial converts to a paid subscription unless you cancel before it ends. Unused trial time is forfeited when you buy a subscription.
- Refunds are handled by Apple under the App Store policy. We generally cannot issue App Store refunds directly. Your statutory consumer rights (including any EU right of withdrawal, to the extent it applies) are not affected.
- Prices may change; we'll give notice as required by the App Store.
7. AI features
Tonic uses artificial intelligence to power features such as meal-photo analysis and conversational coaching. To provide them, content you choose to submit — for example meal photos, messages, and a summary of your progress — is processed by AI services, including third-party AI sub-processors, as described in our Privacy Policy.
- AI output is generated automatically and may be inaccurate, incomplete, or out of date. Use judgement, and see the medical disclaimer above.
- We instruct our AI sub-processors not to use your content to train their models, and we delete submitted content within the retention windows described in the Privacy Policy.
- Don't rely on AI features for professional, medical, legal, or financial decisions.
8. Your content
Everything you log — weight, meals, doses, photos, notes, and the rest — is yours. You grant us only the limited licence we need to operate the Service for you: to store, process, display, and back up your content, and to send it to the sub-processors listed in the Privacy Policy so the features work. We don't sell your content, and we don't use it for advertising. You're responsible for the content you submit and for having the right to submit it.
9. Acceptable use
When using Tonic, you agree not to:
- break the law, or use the Service to harm yourself or others;
- reverse-engineer, decompile, scrape, or attempt to extract source code, except where that restriction is prohibited by law;
- interfere with, overload, or disrupt the Service or its infrastructure, or try to bypass security or rate limits;
- resell, sublicense, or commercially exploit the Service without our written permission;
- submit content that infringes someone else's rights, or that is unlawful, or misuse the AI features to generate harmful content.
10. Our intellectual property
The Service — including the Tonic app, the Tonic name and logo, the mascot, the website, and the underlying software and design — is owned by Prisma Labs and protected by intellectual-property laws. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app for your own personal, non-commercial use, subject to these Terms. Drug names such as Wegovy, Zepbound, Ozempic, Mounjaro, and Saxenda are trademarks of their respective owners; Tonic is not affiliated with any pharmaceutical manufacturer.
11. Third-party services
The Service relies on third parties — including Apple (Sign in with Apple, HealthKit, the App Store) and the sub-processors listed in our Privacy Policy. Your use of those services is also governed by their terms, and we're not responsible for them. Any links to third-party sites are provided for convenience only.
12. Disclaimers
To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied — including fitness for a particular purpose, accuracy, or uninterrupted availability. We don't warrant that the Service will be error-free, that estimates or AI output will be accurate, or that the Service will meet your requirements. Some jurisdictions don't allow certain warranty exclusions, so parts of this section may not apply to you.
13. Limitation of liability
To the fullest extent permitted by law, Prisma Labs will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of (or inability to use) the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us for the Service in the 12 months before the claim, or EUR 50.
Nothing in these Terms limits liability that cannot be limited by law — including liability for death or personal injury caused by negligence, for fraud, or your mandatory rights as a consumer.
14. Indemnification
If your misuse of the Service or breach of these Terms causes a third-party claim against us, you agree to cover the reasonable costs and damages we incur, to the extent the law allows.
15. Changes and termination
We may update, suspend, or discontinue parts of the Service. You can stop using Tonic and delete your account at any time. We may suspend or end your access if you materially breach these Terms or use the Service in a way that risks harm to others or to the Service. Sections that by their nature should survive — ownership, disclaimers, liability limits, and governing law — survive termination.
16. Changes to these terms
If we change these Terms, we post the new version here with a new effective date, and notify you inside the app for any material change. The current version always lives at https://asktonic.com/terms. Continuing to use the Service after a change means you accept the updated Terms.
17. Governing law
These Terms are governed by the laws of the Netherlands, and disputes are subject to the competent courts of the Netherlands — without depriving you of the protection of the mandatory consumer law of your country of residence, or of your right to bring proceedings there where EU law gives you that right.
